These terms explain how Remember My Date may be used, how email reminders work and the responsibilities that come with holding an account.

1. Acceptance of these terms
These Terms of Use apply when you access remembermydate.com, create an account or use the Remember My Date service. By creating an account or continuing to use the service, you agree to these terms and acknowledge our Privacy Policy.
If you do not agree, do not create an account or use the service.
2. About the service
Remember My Date is an online tool for recording birthdays, anniversaries and other personal dates, selecting reminder timing and receiving reminders by email. It may also provide AI-assisted ways to prepare date entries from information you supply.
The service is intended for personal organisation. It is not an emergency alert system, professional diary service or guaranteed delivery service.
3. Completely free use
Remember My Date is provided free of charge. We do not require a credit card and will not charge you without first giving you clear information and obtaining your express agreement.
Some reminder emails may contain clearly identified gift ideas, recommendations, advertising or other promotional content, as explained below.
4. Eligibility and accounts
You must have legal capacity to agree to these terms. If you are under 18, you must have permission from a parent or legal guardian who agrees to these terms on your behalf.
You agree to provide accurate account information, keep your login details confidential and tell us promptly if you believe your account has been accessed without permission. You are responsible for activity performed through your account unless caused by our failure to take reasonable care.
You must not create an account using another person’s identity or allow an account to be used unlawfully.
5. Dates and information you add
You keep ownership of information you add to the service. You give us permission to store, process, reproduce and transmit that information only as reasonably required to operate, secure, maintain and improve the service, provide requested reminders and comply with law.
If you add information about another person, you must have a lawful reason and any permission required to provide and use that information. Do not add sensitive, unnecessary or confidential information about another person.
You are responsible for checking that names, dates, reminder timing and email settings are correct.
6. Reminder and account emails
By enabling email reminders, you request and consent to receiving the reminder emails associated with your chosen dates and settings. We may also send essential account, security, verification, service and legal messages.
Email delivery can be delayed, filtered, rejected or interrupted for reasons outside our control. We do not guarantee that a reminder will arrive at a particular time or at all. You should keep another reliable record of any date where missing it could cause loss, harm or legal consequences.
Remember My Date must not be used as your only reminder for medical, legal, financial, safety-critical, travel or other important deadlines.
7. Promotional content and consent
Some reminder emails may include clearly identified promotions, gift ideas, recommendations or advertising. Where a message is commercial, we will obtain and record consent as required by applicable law, identify the sender, provide current contact information and include a functional unsubscribe method.
You can withdraw consent or unsubscribe using the method provided in the relevant email. We will action valid unsubscribe requests within the period required by law. Unsubscribing from reminder emails may prevent the core reminder service from operating for your account, although essential account or security messages may still be sent where permitted.
You must not enter another person’s email address to receive promotional or reminder emails unless that person has knowingly agreed to receive them.
8. AI-assisted features
AI-assisted features may misunderstand speech, names, relationships, dates or instructions. They are provided to make data entry easier, not to make decisions for you.
You must review AI-prepared entries before saving and correct anything that is incomplete or inaccurate. You remain responsible for the final information and settings in your account.
9. Acceptable use
You must not:
- use the service for unlawful, fraudulent, abusive, threatening or harmful activity;
- send unsolicited messages or add email addresses without the required consent;
- attempt to gain unauthorised access to accounts, systems, code or data;
- introduce malware, scrape the service excessively, interfere with normal operation or bypass security controls;
- reverse engineer or copy protected parts of the service except where the law gives you a right that cannot be excluded; or
- use automated processes in a way that places unreasonable load on the service.
10. Our intellectual property
The Remember My Date name, logos, website design, software, text, graphics and other service materials are owned by or licensed to HiGoTec Pty Ltd and protected by applicable intellectual property laws.
We give you a limited, revocable, non-exclusive and non-transferable right to use the service for its intended personal purpose while you comply with these terms.
11. Service providers and external services
We may use reputable hosting, email delivery, security, analytics, support and AI technology providers to operate the service. Their systems may process information on our behalf under contractual or legal safeguards.
Links, promotions or recommendations may lead to external websites. Those websites are operated under their own terms and privacy practices. We are not responsible for an external website merely because it is linked or mentioned.
12. Availability, changes and account closure
We may maintain, update, improve, suspend or discontinue parts of the service. Where reasonably possible, we will give notice of a material change that significantly affects existing users.
You may stop using the service and request account closure. We may restrict or close an account where reasonably necessary to address a breach of these terms, unlawful use, security risk, harm to another person or discontinuation of the service.
Following closure, information may be deleted or retained as described in our Privacy Policy and as required by law.
13. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or another applicable law.
Subject to those rights, the service is provided on an “as available” basis. We do not promise uninterrupted operation, perfect accuracy, permanent storage or guaranteed email delivery.
14. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from a missed reminder, inaccurate information supplied by a user, an AI-prepared entry not checked by a user, email filtering, third-party service failure or use of the service contrary to these terms.
Where liability cannot be excluded, it is limited only to the extent permitted by law. This section does not limit liability for fraud, wilful misconduct or another liability that the law says cannot be limited.
15. Privacy
Our Privacy Policy explains how we collect, use, disclose, secure and retain personal information, including date information and data used by AI-assisted features.
16. Changes to these terms
We may update these terms to reflect service, legal or operational changes. The latest version will be published on this page with its effective date. If a change materially affects your rights or how the service is used, we will take reasonable steps to notify registered users before it takes effect.
17. Governing law and disputes
These terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and courts entitled to hear appeals from them, subject to any mandatory rights you have under the law where you live.
Before starting formal proceedings, each party should make a genuine attempt to resolve the dispute by giving the other written details and allowing a reasonable opportunity to respond.
